    McRib lawsuit, Is nothing sacred anymore?

    Good grief,
    McDonald's is facing a lawsuit over its iconic McRib

    New York, California, Illinois, and the District of Columbia are also suing….you don’t say.

    Don’t these people have anything better to do with their lives?(spoiler alert, they don’t) No one goes to McDonald’s for health food.

    Plus, I’ve never seen an ad from them that says “100% pure pork rib meat” or anything close to that. A McRib is just that, a McRib. It looks like a rib, that is good enough for me. It’s a fun name to sell sandwiches. For the love of god. Grow up. Stop wasting resources over stupid, meaningless lawsuits.

    Now that they mention it..... about a year ago I ate a Burger King Whopper. To my abject horror, there was no trace, not a hint of the iconic Whopper Candy in it. I was deceived! Psychologically maimed!

    For the good of the nation, I should see if I can get a lawyer to file a class action lawsuit against Restaurant Brands International, the parent company of Burger King. Anyone want in with me?

    What was that? You don't say! Gasp! What do you mean the State of Washington doesn't look like George Washington?! We have been misled for one hundred thirty-six years! Get me the State Department!!

    In all seriousness, I wonder if a legal strategy would be that McRib as a trademark has existed for so long that it has long ceased any implication of rib meat; that is, it's become its own thing (yes, even though it has the letters 'rib' in it).

    There has to be brands or other trademarks that reference something that the object never was to begin with..... I just can't think of any off-hand.

      In all fairness, in that instance the coffee was scalding hot (180-190F) and caused extensive 3rd degree burns in the pelvic region of the woman. The photos of her injuries are disturbing. She underwent extensive medical treatment with costs in the 10’s of thousands of dollars and all McDonald’s offered was $800.

      Donw don't forget that they had 700 prior complaints of injury from the overheated coffee, that the woman's last demand before trial was $20k for medical expenses and lost income and that part of the defense presented was that the 700 or so injuries were insignificant because they sell billions of cups of coffee.

    Red Bull also suffered a class action lawsuit for false advertising that resulted in a payout of $13 million dollars.

    A US citizen asked the question "why doesn't Red Bull give me wings?" and sued the company for false advertising. He claimed that after 10 years of drinking Red Bull, he had neither grown wings nor had seen any athletic or intellectual enhancement in his performance.

    Red Bull changed their slogan to "Red Bull gives you wiiings"

    With that being said, I have never had a Red Bull or a McRib sandwich. So, no payout for me.

      TripleB -- I have no doubt that you did. Reporters tend to spin these things to make their articles more interesting (click-bait) and defendant's do the same to minimize their perceived culpability. I just wanted to provide another point of view.

    Lawyer here. I'd suggest watching the 2011 doc Hot Coffee (usually on Hulu).

    edited to add: I am not co-signing the McRib lawsuit to be clear, just addressing side discussion re McDonald's coffee burn case.

      Yes, good suggestion. People don't understand why there was a law suit. They read a headline like, "McDonalds sued for hot coffee," and they don't bother to find out what the suit was actually about. Poor woman needed plastic surgery.

      Yes - I've read the details of that case, and how McDonald's dialed down the temp of all their coffee makers afterwards. And then steadily ramped them back up to scalding over the years since...

        I never gave a second thought to was a McRib sandwich consists of. I no longer eat at McDonalds. I used to get the fish now and then, and that just got gross. 🤮
        Anyway, the suit could get dismissed if McDonalds shows the McRib is made from pork meat.

          I would assume it's just various pork product, but rib meat presumably would be expensive to process into patties, unless you are simply grinding the bones until they are deemed edible. Not ruling that out.
